On May 30, 2023, Governor Ron DeSantis’s signature sealed the enactment of HB1379, ushering in significant revisions to various statutes linked to Basin Management Action Plans (BMAPs) and Florida Statute 381.0065. Most notably, these statutory changes mandate that new system construction permits on lots of one acre or less in BMAP areas, Reasonable Assurance Plan (RAP) areas, and Pollution Reduction Plan (PRP) areas must include Enhanced Nutrient Reduction Onsite Sewage Treatment and Disposal Systems (ENR-OSTDS). The legislation affects 57 counties throughout the state of Florida.

A map for permitting that includes parcel information is being developed by the Department of Environmental Protection. In the meantime, you can refer to this map posted on FDEP’s website to see which areas are impacted by the new requirements. On the “content” tab, turn on only the “Alternative Restoration Plans” and “Statewide Basin Management Action Plan” layers. After you click on the “legend” tab, you will see which areas are covered by a BMAP, RAP or PRP. This law also extends to all springs that have previously implemented springs protection BMAPs, except for Volusia Blue Springs, which is still in the process of developing a BMAP.
